I don't think you are correct in the way you are categorizing the agreement and it's expiry date. The EXCLUSIVITY DATE was July 31st and there was no mention of an extension by either party. If this is what you are refering to then you are CORRECT.

However, what you posted says "Did the 7/31 agreement expire? Absolutely (there is no other official word or evidence to the contrary). They tap dance around "It wasn't terminated or we'd have to say so". It didn't have to be, it expired on its' own."

This is INCORRECT!

On page 5 under TERMINATION it clearly says "

5. Termination
This Agreement shall be terminated on the earlier of (i) the date of execution and delivery of the A&F Agreement; and (ii) 5:00 p.m. (Toronto time) on July 31, 2010 or such later date as mutually agreed, without any liability to the parties other than any liability accrued to the date of termination related to any breach by a party of its obligations hereunder and any obligation Crystallex may have to pay the termination fee set out in Section 6.

Did the period of exclusivity expire? Yes, but that doesn't matter since they already have an agreement in place that is being put together to be sent to shareholder to vote on.

Was the agreement terminated? NO, they have an agreement that is in the process of being prepared for mailing to shareholders.
